AdaptGroup Infrastructure Acceptable Use Policy (AUP)

1. Scope
This policy defines acceptable use of virtual machines, dedicated servers, IP addresses, and network resources provided by AdaptGroup LLC ("AdaptGroup"). It applies regardless of how the service is ordered or managed, including through Cloud Bots, Cloud API, and AdaptGroup partners.
In this policy, the customer is the person using the provided resource. A resource means a virtual machine, dedicated server, IP address, or another part of the infrastructure provided.
Payment, renewal, and ordinary termination of rental are governed by the Infrastructure Terms and the terms of the relevant service. Availability commitments and downtime compensation are governed separately by the SLA.
2. Prohibited Use
The following activities are prohibited on AdaptGroup infrastructure.
2.1. Tor and Darknet Platforms
Use of the Tor network, including running Tor clients, entry, middle, and exit relays, bridges, and onion services. Hosting and operating darknet platforms is prohibited.
2.2. Mining
Cryptocurrency mining using the provided computing resources, including miners running directly in the operating system, in containers, or in nested virtual environments.
2.3. Torrents
Downloading and distributing files through torrent protocols, and operating torrent trackers and torrent distribution services. This prohibition applies regardless of rights to the distributed material.
2.4. Fraud and Phishing
Hosting and operating fraudulent services, counterfeit websites, and phishing pages; deceiving users to obtain money, credentials, payment information, or other confidential information.
2.5. Malware and Botnets
Distributing malicious software, infecting other people's devices, controlling botnets, or hosting infrastructure for ransomware and other tools intended to harm other systems or data.
2.6. Attacks and Unauthorized Access
Conducting or facilitating DoS or DDoS attacks, attempting to crack other people's passwords, exploiting vulnerabilities or scanning third-party systems without their owners' permission, and other activities that compromise the availability, integrity, or confidentiality of other systems or data.
2.7. Spam
Sending unsolicited bulk messages by email, messaging services, contact forms, or other services, and providing infrastructure for such messaging.
2.8. Illegal Material and Infringement of Third-Party Rights
Hosting, distributing, or selling material or data in violation of applicable law or third-party rights. In particular, child sexual exploitation material, the sale of stolen data, and unlawful distribution of copyrighted material are prohibited.
Copyright complaints are handled under the separate Copyright Complaints / DMCA Policy.
2.9. Interference with Infrastructure
Attempts to gain unauthorized access to hypervisors, management systems, or other customers' resources; use of unassigned IP addresses; spoofing network identifiers to bypass isolation; interference with routing; and circumvention of imposed restrictions.
3. VPN
Personal VPNs and corporate VPNs for an organization's internal needs are permitted subject to the rest of this policy. A company's use of a VPN to give employees access to internal resources does not, by itself, constitute a commercial VPN service.
Providing or reselling VPN access to third parties on a commercial basis is prohibited on standard infrastructure.
Customers operating commercial VPN projects may contact AdaptGroup support to arrange separate infrastructure. A commercial VPN service may not be launched before that arrangement is agreed.
Separate VPN infrastructure does not remove the prohibitions on attacks, spam, fraud, or other violations of this policy.
4. Resource Usage and Network Limits
The customer must use resources within the plan specifications and published technical limits. Activities intended to bypass limits or disrupt infrastructure or other customers' resources are prohibited.
Speed limits triggered by exhaustion of paid traffic or a sustained usage threshold specified for the service are applied under the plan terms. Such a limit does not, by itself, confirm an attack or justify an abuse warning.
Mail ports covered by the SMTP policy are blocked by default on virtual machines. Opening them is subject to the established review and approval procedure; opening ports does not permit spam.
5. Complaints and Verification
Reports from providers, data centers, rights holders, affected persons, and other complainants, as well as AdaptGroup's own technical information, may initiate an investigation.
Abuse complaints should be sent to [email protected]. To respond to a notice or challenge a restriction, customers may use the channel through which they received the notice or contact support at [email protected] or Telegram @adapt_support.
Receipt of a complaint does not, by itself, establish a violation. The review considers the submitted material, IP address and event time, and the party to whom the resource was assigned at the time of the alleged violation. Duplicate reports of the same event do not automatically count as separate violations.
Depending on the complaint, evidence may include logs, page addresses, message headers, and other material that helps verify the circumstances. High CPU or bandwidth usage alone does not prove unlawful activity.
The customer may provide an explanation, report that the issue has been remedied, or dispute the complaint with reasons and supporting material. Responses and review outcomes are retained in the complaint history.
6. Notices, Deadlines, and Suspensions
6.1. Notice and Response Deadline
Unless immediate restrictions are required, AdaptGroup sends a notice describing the alleged violation, affected resource, required action, and response deadline.
The standard response period is 24 hours from the time the notice is sent. An administrator may set a different period based on the circumstances; the specific deadline date and time are stated in the notice.
Within the stated period, the customer must report the action taken or provide a reasoned explanation, including any objections to the complaint. Sending a response does not, by itself, establish that the violation has been resolved: an administrator reviews its substance.
If the customer does not respond by the deadline, the resource is suspended pending investigation.
6.2. Immediate Restrictions
Where there are reasonable indications of an active attack or another immediate threat, AdaptGroup may immediately restrict network access or suspend a resource pending investigation, without waiting for a customer response or issuing prior warnings.
This may apply, in particular, where logs of an outgoing DDoS attack or other technical evidence indicate a threat.
If an incoming DDoS attack against a customer's server threatens the stability of a node, the network, or other customers' services, AdaptGroup may temporarily limit traffic, block network access, or suspend the attacked server without prior notice. Restrictions are lifted once the threat ends or service can be safely restored. An incoming attack does not, by itself, establish a customer violation or justify data deletion or permanent rental termination. The paid term continues to run; this protective restriction is excluded from SLA compensation.
6.3. Review and Restoration of Access
There is no fixed number of warnings before suspension or termination. Decisions take into account the nature of the violation, evidence, recurrence, and the customer's response.
After the violation is remedied, an administrator verifies the result and manually lifts the suspension. If a complaint is found to be unfounded, it ceases to be grounds for suspension.
A temporary suspension pending investigation does not, by itself, constitute permanent termination or automatic deletion of data.
7. Paid Term and Termination
During suspension for a violation, the paid rental term continues to run. The expiry date is not moved and the suspension period is not added to the service term.
For a confirmed violation, AdaptGroup may permanently terminate service for the affected resource. Service and access end; no additional time is provided to transfer or obtain a copy of the data.
After permanent termination, data retention and recovery are not guaranteed, and data may be deleted. This does not turn a temporary suspension pending investigation into a decision to delete data.
Where service is permanently terminated for a violation, no refund is given for the remaining paid period except where a refund is required by applicable law.
